Court Moves On Suit To Imprison Adams Oshiomole

A federal High Court sitting in Bwari, Abuja, seeking to commit the National Chairman of the All Progressives Congress (APC), Adams Oshiomhole, to prison for flagrant disobedience of Order of Court, has been slated for hearing on February 18.

In the Suit No: FCT/HC/BW/CV/103/2018, the Claimant, Evan Enwerem, sought an Order of Court to commit Adams Oshiomhole to prison for the flagrant disobedience of an Order of the Court restraining him from tempering with the tenure of the elected APC State Exco in Imo State, which was issued on August 14, 2018.

Defendants in the suit include the APC, National Chairman of the APC Adams Oshiomhole (2nd Defendant) and Imo State Chairman of the APC Daniel Nwafor (3rd Defendant/Applicant).

The Motion on Notice reads in part:

“Take Notice that this Honourable Court shall be moved on the 18th Ďay of February 2019, at the hour of 9 O’clock in the fore noon or so thereafter as Counsel on behalf of the 3rd Defendant/Applicant may be heard praying the Court for the following;

“An Order Committing Adam’s Oshiomhole, the National Chairman of the All Progressives Congress ( APC), the 2nd Defendant to Prison for disobeying the Order of this Honourable Court made on the 14th Day of August 2018. And for such Order(s) that the Honourable Court may deem fit to make in the circumstances.”

The Grounds for Application as contained in the Notice Motion, read that, “the Contemnor/party sought to be committed, disobeyed the Order of this Honourable Court made on the 14th Day of August, 2018.

“The disobedience of the Court Order has continued till date.”

It also added that, “despite the service of the Mandatory Forms to the 2nd Defendant/party sought to be committed, he has continued in defiance of the Order of this Honourable Court.

“It will be in the interest of justice to grant this Application so as to preserve the sanctity of the Honourable Court.”
